Massachusetts appellate court rules in favor of firm’s client in challenge involving the Commonwealth’s anti-SLAPP statute
Goldman & Pease, LLC is pleased to announce that attorney Liam Floyd has secured an important appellate victory on behalf of his client in a Massachusetts anti-SLAPP case.
At the Superior Court level, Goldman & Pease successfully opposed a Defendant’s Motion to Dismiss based upon Massachusetts General Laws Chapter 231, Section 59H, the Commonwealth’s anti-SLAPP statute. That statute provides a mechanism for dismissing a party’s claim when it can be shown that the action was brought only to inhibit another party’s exercise of the party’s right to petition and bring certain litigation related to that petitioning activity. SLAPP stands for Strategic Litigation Against Public Participation.
The appellate court’s decision represents a significant result for the firm’s client and reflects the importance of careful legal analysis and effective appellate advocacy in cases involving the scope and application of Massachusetts anti-SLAPP protections.
Attorney Floyd explained the Court’s analysis relied upon the appropriate “Standard of Review”:
“The crux of the decision relied on what is often considered a routine part of an appeal, the “standard of review.” Typically in an appeal involving anti-SLAPP motions, the Appellate Court reviews the lower court “de novo.” That is, the Appellate Court reviews the underlying motion from scratch, giving no deference to the lower court’s decision or analysis. However, as the lower court decision relied mainly upon the timing of the motion rather than the substance, we successfully argued that the “abuse of discretion” standard should apply. The abuse of discretion standard is a much higher standard for an appellant to meet as he must show that the judge’s decision was “a clear error of judgment . . . outside the range of reasonable alternatives.” The Appeals Court applying the “abuse of discretion standard” was able cut through the appellant’s argument, and uphold our original decision.”
Goldman & Pease, LLC congratulates Liam Floyd on this successful appellate outcome. The firm remains committed to providing thoughtful, strategic representation to clients facing complex litigation and appellate issues.
